I had an idea for a fake demo that showed off DS hardware. Since it would be made by nintendo(if it existed) would that count as an IP, or would I have to use actual copyrighted characters?

I guess it would count as a Nintendo DS fangame, so I'd say it would be allowed. It uses the Nintendo DS IP.
