Online marketplaces don't necessarily have the resources to police everyone's content... they say not to use content without permission in their rules so that they don't get in trouble for hosting your rip. The larger stores might screen your game, but in any case the main concern is that if your infringing project gets enough attention, the original copyright owner will be the one coming after you with buckets of cash and a vested interest.
