About using the asset as NFT

Hello, I am a blockchain game developer. I feel extremely interested to your asset and I want to include them in my game. However, except for normal usage in the game, we would need to reproduce those assets to NFT for the game’s marketplace purpose. Without turning the asset to NFT, the whole game idea will not work. I wonder if I get that permission from you after we purchased your asset? We will add credit to every NFT we produced.

For the NFT, it is basically an image linked to an ID. The asset itself will not sell to the public. Our game will load the NFT (which basically a bunch of data), and show the game asset of yours in the screen. The asset itself stays in the game and is not sold or redistributed to the public. Therefore, the asset is not actually selling to others, just a medium to access our game.

Please advice me for this issue, and tell me if any problem or issue you are facing about granting the permission for us! Thanks a a lot.

Regards,

Chris

Hello Chris, good day! You bring a great point as I've never considered the possibility of our assets being used in NFTs. Upon deliberation however, we've come to the conclusion that we won't extend the usage of these packs to NFTs.

You're allowed to use the assets to create games, novels, animations and other pieces of educational or entertainment media for free or commercial use, with no attribution required. Redistributing or commercializing the assets directly, or anything fashioned from them such as plushies or NFTs, is generally* not permitted. Thank you for your understanding,

-Jo

*you need to ask for additional permission for such uses. NFTs are, due to many different points but in particular to allow every customer to have equal usage rights, unlikely to be something ever permitted, however.

Hi, Thanks for the reply. I feel sad to hear that news, but I want to give you some extra info for you so you may reconsider our request.

 1. The NFT will be modified (by adding a frame to indicate the rarity). (Or not, if you do not want to.)

 2. We are not selling the NFT directly, and we will not sell the NFT to NFT marketplaces (i.e opensea). The way that players can get an NFT, is to mint in our website. At that time, a random id will be given to the player and will be linked to a random game asset designed by you. Once the player's wallet contains the NFT data, they can use that character in our game. They will load the ID into the game and will load the game model in our storage. In fact, what they own is a bunch of data, not the game asset itself since the game asset is just the interface of the NFT, the data (or battle statistics) is the key of it.

 3. Although the player's wallet will contain the NFT data, which means they can sell the NFT in opensea, what they are trading is actually the ID of the NFT, not the game asset itself. The ID will be linked to our game data, like skills, statistics, material etc, which is valued in the game. Thats all I want to share with you, hope you can reconsider our request! Thanks a lot. Regards,

Chris

Thank you for the clarification. That does sound reasonable, however, we will remain out of any involvement with NFTs for the time being.

Have a great day!
