can i use the amen break?

like the title says, im wondering if i can use the amen break in my songs, as its kinda needed in the genre of songs im planning to make for this jam (breakcore), but its kinda in a copyright gray area where its copyrighted but  nobody really cares if you use it so idk

if i cant use it thats fine, ill just sound design some custom breaks :)

I've seen some other commisions in the last Jam that had used the Amen Break as well. It seems to have been fine. I  think as long as you use the sample in an transformative way for your song, it should be fine. However I am no lawyer, so take it with caution.

just use custom breaks - they are pretty easy to make + sound cooler because they are unique :)

Agreed very easy to make you can play some drums at like a low bpm then pitch it back up and resample your own sample 

You're probably fine since a loooot of artists used amen breaks with no issues, it's used everywhere and no one will sue you unless it's nintendo or something
