Can i publish my remake of an official (abandoned) game here?

The TOS say:

Publishers affirm, represent, and warrant that they own or have the rights, licenses, permissions and consents necessary to publish, duplicate, and distribute the submitted content

The Company does not endorse copyright infringing activities or other intellectual property infringing activities and violations of may result in the removal of content if the Company is notified of such violations. Removal and termination of accounts may occur without prior notice.

Strictly speaking, you shouldn't upload anything that you don't have the rights to share.

But Itch doesn't do copyright checks, you can upload the game, but if someone claims the rights, they can take down the game or close your account, you have to be clear about that.

Be careful, just because a company closes doesn't mean that its products aren't actively protected, it often happens that another company buys the rights to those products.

you will have issues if you post either game released 2004 by ea black box. it's ea. they still own it. I don't think they're like nintendont, but I really don't know.
also, ea is garbage. never buying a game from them again.

Make a Remake or Make a different. Or Both. If you Use Environment, what to think about? If you want something else, like …, it is lawyer and establishment ideal world and in practice you need something different to fill your duty. If you need your success it depends on your project settings… And thats not easy… For inspiration look at https://itch.io/profile/leafo but thats also not the answer for your problem… But also there are games or applications when even Studios need their orig for current needs and knowledge and thats problem on current hw also…

You can't remaster something you did not create in the first place. Or have the rights to and the source codes.

If you created a game that looks suspicously like an old game from 20 years ago and did in fact not violate any copyrights or trademarks, you might be good. There are plenty of games that are knock offs of inspired by other games. Some even better than the original.

If you repurposed the old game files, use the old title and act in a way that someone could mistake you for the original creator (by using the term remaster for example), it looks less good. Ask yourself, if you could claim copyright and more importantly trademarks for your content or not.
